Op huyden den vijffden Augusty
anno 1706 compareerde voor mij Cornelis s'Grave-
sande, notaris publicq, bij den Hove van Holland geadmitteert,
binnen de stad Delft residerende, in de tegen-
woordigheyd van de naergenoemde getuygen, juffrouw
Maria Rotteveel, weduwe van Sr. Jacob s'Gravelaer zaliger, woonende
binnen dese stad, mij notaris bekend, dewelke verklaer-
de gecommitteert en gestelt te hebben, te committeren
ende te stellen bij desen, d'heer Theodorus van der Lee,
bedienaer des Godlijcken woords binnen Leyden, haeren
swaeger, ende Sr. Simon Simonsz Mesch, haer compa-
rantes neeff, tot executeurs en bewindhebbers in haere
boedel en sterffhuyse, specialijk omme ordre te stellen
op de begraeffenisse, het maecken van staet en inventa-
ris, item scheydinge en verdeylinge des boedels, mitsgaders 
omme ten dien eynde verkoopinge, t'sij publycke off onder de hand,
item opdrachte van vaste off onroerende goederen te doen ende wijders
omme alles meerder te doen en verrigten t'gunt tot vereffeningh
des boedels vereyscht sal werden gedaen te sijn, met
soodanige ampele last en macht als eenige testamentaire
executeurs eenigsints naer regten toekomt, niet wil-
lende dat sigh ymand buyten de opgemelte executeurs
met de vereffening en scheydinge van haer comparantes boedel
en sterffhuyse sal bemoeyen, aucthoriserende sij comparante mede wel
expresselijk / bij desen den voorn. haeren neeff Simon Simonsz Mesch
omme vermits de swakheyd van de comparantes suster
Barbara Rotteveel, weduwe Simon Mesch zaliger, haer intresse
in den boedel van de comparante waer te nemen,
mitsgaeders haer persoon in alles daer het noodigh sal
wesen te representeren, soo in de schiftinge en scheydinge
des boedels, als andersints, verklaerende voorts sij
comparante tot vooghden over alle onmondige en toesigt-
behoevende persoonen, die onder haere erfgenamen gevon-
den mochten werden, bij desen te committeren ende te
stellen den opgemelten heer Theodorus van der Lee ende
Sr. Simpon Simonsz Mesch, dogh ten respecte van den
voorn. heer Van der Lee niet anders als dat sijn Ed. ver-
mits sijne hooge jaeren het vermogen sal hebben om 
een ander bequaem persoon in sijn plaets tot medevoogt te stellen,
gevende aen de opgemelte gestelde voogden
soodanige ampele last, macht, aucthoriteyt en bevel
als aen eenige vooghden over onmondige gegeven kan
werden, specialijk omme bij affsterven, onbequamheyd
off andere voorvallende ongelegentheyd van een van
henluyden een andere bequaem persoon in des ontbreken-
dens plaets te surrogeren en verkiesen, welke te ver-
kiesene vooghd off vooghden wederom gelijcke macht /
hebben sullen, met macht mede omme de onroerende
en vaste goederen der minderjaerige soo wel als de roe-
rende te verkoopen, transporteren en vervremden, t'sij
in het openbaer off onder de hand, sonder daertoe off
een gedeelte vandien eenige naedere last off aucthori-
satie van eenigh hoff off gerecht van nooden te
hebben, exuserende ende uytsluytende wel expresselijck
alle heeren weesmeesteren en gerechten, specialijk de Ed.
heeren weesmeesteren deser stad, ofte van de plaets
daer des somparantes sterffhuys sal komen te
vallen, de minderjaerigen woonachtigh, off derselver goe-
deren gelegen mochten sijn, dogh alles behoudens haer
ende eens yders Ed. eerwaerdigheyd bij desen. Ende 
versogte sij comparante hiervan kennisse gedraegen,
mitsgaders instrumenten gemaeckt en gelevert te werden in forma.
Aldus gedaen en verleden binnen Delft, ter presentie
van Caspar van Graeuwenhaen ende Leendert Voorstat,
beyde clercken mijns notaris, als getuygen van gelooff hier-
toe versogt.

On the present fifth of August
in the year 1706, Cornelis s'Gravesande, notary public, admitted to the Court of Holland, residing within the city of Delft, appeared before me, in the presence of the witnesses named after her, Miss Maria Rotteveel, widow of Sr. Jacob s'Gravelaer, deceased, residing within this city, notary known to me, who declared to have committed and appointed, to commit
and appoint hereby, Mr. Theodorus van der Lee, minister of the Divine Word in Leyden, her brother-in-law, and Sr. Simon Simonsz Mesch, her nephew, as executors and administrators in her estate and death house, especially to put order to the funeral, to make a statement and inventory, to the separation and division of the estate, as well as to sell for that purpose, whether publicly or privately, to make an order for fixed or immovable property and furthermore to do and perform everything more that may be required for the settlement of the estate, with such ample authority and power as any testamentary executors are entitled to by law, not wanting anyone besides the aforementioned executors to be involved in the settlement and division of her declarant's estate and death house will be concerned, authorizing she declarant also expressly / hereby the aforementioned. her nephew Simon Simonsz Mesch  in order to take care of her interest in the estate of the declarant, as well as to represent her person in everything that may be necessary, both in the sifting and separation of the estate, as otherwise, further declaring she declarant to be guardians of all minors and persons in need of supervision, who may be found among her heirs, hereby to commit and appoint the aforementioned Mr. Theodorus van der Lee and Sr. Simpon Simonsz Mesch, but with respect to the aforementioned Mr. Van der Lee not otherwise than that of his Ed. since his advanced years will have the power to appoint another competent person as co-guardian in his place,
giving to the aforementioned appointed guardians such ample mandate, power, authority and command as can be given to any guardians over minors, especially in order to surrogate and elect another competent person in the absent place in the event of the death, incapacity or other incidental inconvenience of one of them, which guardian or guardians to be elected will again have equal power, with the power also to sell, transport and alienate the immovable and fixed goods of the minor as well as the movable property, either publicly or privately, without to that end or a part of that any further charge or authorization of any court or justice of necessity, excluding and expressly excluding all lords orphan masters and courts, especially the Ed. lords orphan masters of this city, or of the place where the sumparant's death house will fall, the minors residing, or their goods may be situated, but all subject to their and everyone's Ed. veneration in this. And requested that they inform the comparator of this, as well as instruments to be made and delivered in form. Thus done and passed in Delft, in the presence of Caspar van Graeuwenhaen and Leendert Voorstat,
both clerks of my notary, as witnesses of faith herein requested.

Dear Anne, even the notary thought at one turn he was writing Maria's will, but he had to cross out on the second page (fol. 339v) the very word testatrice and substitute the word comparante! Maria Rotteveel nominates in this act as future executors for her will her brother in law Theodorus van der Zee, a vicar in Leiden, and her nephew Simon Simons Mesch.

On the second page Simon Simons Mesch is explicitly instructed to represent her sister Barbara Rotteveel in the execution of Maria's will. One of the provisions in this act is the exclusion of the orphan chamber. Two notary clerks act act and sign this document sd witnesses.

Some times when I read these legal documents I wonder if the notaries were paid per word as they seem to repeat so much :-) but that's me being cynical. I'm sure there were strong legal arguments: i.e. there could be no doubt about what was intended, although as Otto points out even then mistakes could be made and needed to be corrected.
